Taylor, the U.S. Supreme Court Case About Banning LGBTQ-inclusive Books"},"content":{"rendered":"<p>The Supreme Court of the United States is scheduled to hear oral arguments in\u00a0<em>Mahmoud v. Taylor\u00a0<\/em>on\u00a0Tuesday, April 22, 2025.<\/p>\n<p><a href=\"https:\/\/www.supremecourt.gov\/Search.aspx?FileName=\/docket\/docketfiles\/html\/public%5C24-297.html\" target=\"_blank\" rel=\"noopener\"><i><span style=\"font-weight: 400;\">Mahmoud v. Taylor<\/span><\/i><\/a><span style=\"font-weight: 400;\"> is about a small number of LGBTQ-inclusive children\u2019s books included in the classrooms of Montgomery County (Maryland) Public Schools. The books were chosen and evaluated by education professionals. Six parents (three couples) sued the school district board of education claiming their religious freedom was violated by not having an option to opt out their children from classrooms where the books might be part of curriculum, including when offered as nonmandatory supplemental learning materials.<\/span><\/p>\n<p><b>Context to know and report:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In 2022, Montgomery County Public Schools (MCPS) in Maryland expanded their curriculum book collection with nine inclusive picture books for children. An MCPS committee selected the titles and completed the necessary evaluation forms, which were then reviewed by a content supervisor, according to district protocol.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The school board stated in legal <\/span><a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24-297\/335502\/20241218150621210_24-297%20-%20Mahmoud%20v.%20Taylor%20-%20Brief%20in%20Opposition.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">filings<\/span><\/a><span style=\"font-weight: 400;\">, \u201cthe books are made available for individual reading, classroom read-alouds, and other educational activities designed to foster and enhance literacy skills.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A district official said the books were to be <\/span><a href=\"https:\/\/mombian.com\/2025\/01\/21\/supreme-court-to-hear-case-on-whether-reading-lgbtq-books-in-school-requires-parental-opt-out-option\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">integrated<\/span><\/a><span style=\"font-weight: 400;\"> \u201cinto the curriculum in the same way that other books are used, namely, to put them on a shelf for students to find on their own; to recommend a book to a student who would enjoy it; to offer the books as an option for literature circles, book clubs, or paired reading groups; or to use them as a read aloud.\u201d<\/span><img fetchpriority=\"high\" decoding=\"async\" class=\"alignright wp-image-933505\" src=\"https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125028\/allies.jpg\" alt=\"\" width=\"300\" height=\"300\" srcset=\"https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125028\/allies.jpg 1800w, https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125028\/allies-300x300.jpg 300w, https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125028\/allies-1024x1024.jpg 1024w, https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125028\/allies-150x150.jpg 150w, https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125028\/allies-768x768.jpg 768w, https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125028\/allies-1536x1536.jpg 1536w, https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125028\/allies-450x450.jpg 450w, https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125028\/allies-1200x1200.jpg 1200w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The district\u2019s communications director, Jessica Baxter, <\/span><a href=\"https:\/\/bethesdamagazine.com\/2022\/12\/14\/mcps-six-new-lgbtq-elementary-school-books-met-with-overwhelming-community-support\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">said<\/span><\/a><span style=\"font-weight: 400;\"> the books tell \u201cjoyful stories of folks who happen to be part of the LGBTQ+ community,\u201d and that they \u201ccelebrate and positively portray LGBTQ+ identities.\u201d\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Three couples <\/span><a href=\"https:\/\/www.the74million.org\/article\/supreme-court-agrees-to-hear-montgomery-parents-challenge-to-lgbtq-book-rules\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">filed a lawsuit<\/span><\/a><span style=\"font-weight: 400;\"> against MCPS in 2023, objecting to the books and claiming the district infringed on their religious rights by not allowing them to opt out their children from potential exposure to the books.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The plaintiffs ar<\/span><span style=\"font-weight: 400;\">e represented by Becket, formerly known as Becket Fund for Religious Liberty, a legal group with an anti-LGBTQ history that includes representing a school that <\/span><a href=\"https:\/\/www.indystar.com\/story\/news\/2023\/01\/27\/former-roncalli-counselor-who-was-fired-for-being-gay-files-appeal\/69849509007\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">fired a 15-year veteran teacher<\/span><\/a><span style=\"font-weight: 400;\"> for being gay and marrying her partner of 25 years. Southern Poverty Law Center describes Becket as a \u201c<\/span><a href=\"https:\/\/www.splcenter.org\/20160211\/religious-liberty-and-anti-lgbt-right\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">hardline<\/span><\/a><span style=\"font-weight: 400;\">\u201d group that promotes legislation and lawsuits to justify anti-gay discrimination. Becket has also vigorously pursued banning <\/span><a href=\"https:\/\/www.reckon.news\/justice\/2023\/08\/what-you-need-to-know-about-becket-law-the-legal-advocacy-group-thats-escalating-the-abortion-crisis.html\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">access to abortion<\/span><\/a><span style=\"font-weight: 400;\"> and access to contraception.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">People of faith support LGBTQ people and equality, and LGBTQ people are also <\/span><a href=\"https:\/\/www.prri.org\/research\/lgbtq-rights-across-all-50-states-key-insights-2024-prri-american-values-atlas\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">people of faith<\/span><\/a><span style=\"font-weight: 400;\">. <\/span><a href=\"https:\/\/www.pewresearch.org\/religion\/2025\/02\/26\/religion-and-views-on-lgbtq-issues-and-abortion\/#acceptance-of-homosexuality\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">67%<\/span><\/a><span style=\"font-weight: 400;\"> of adult Americans say being LGBTQ should be accepted by society, including 59% of religiously-affiliated adults.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/williamsinstitute.law.ucla.edu\/publications\/public-opinion-religious-exempt\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Two-thirds<\/span><\/a><span style=\"font-weight: 400;\"> of U.S. Catholics, Protestants and other Christians oppose using religious beliefs as an excuse to discriminate against LGBTQ people.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/williamsinstitute.law.ucla.edu\/publications\/lgbt-parenting-us\/\" target=\"_blank\" rel=\"noopener\"><b>UCLA\u2019s Williams Institute<\/b><\/a><span style=\"font-weight: 400;\">: 2.6 million LGBTQ adults are raising children under age 18.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">24% of all LGBTQ parents live in the Northeast U.S., which encompasses Maryland. 31% live in the U.S. South. Approximately 5 million children in the U.S. are being raised by an LGBTQ parent. 20% of LGBTQ people in <\/span><a href=\"https:\/\/williamsinstitute.law.ucla.edu\/visualization\/lgbt-stats\/?topic=LGBT&amp;area=24&amp;sortBy=percentage&amp;sortDirection=descending#ranking\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Maryland<\/span><\/a><span style=\"font-weight: 400;\"> are raising children.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">PEN America has <\/span><a href=\"https:\/\/pen.org\/book-bans\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">documented<\/span><\/a><span style=\"font-weight: 400;\"> more than 16,000 book bans in public schools nationwide since 2021, predominantly targeting books by and about LGBTQ people and books about people of color and race and racism. In its latest report <\/span><a href=\"https:\/\/pen.org\/report\/cover-to-cover\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Cover to Cover<\/span><\/a><span style=\"font-weight: 400;\"> in February, the organization found <\/span><span style=\"font-weight: 400;\">29% of all banned titles during the 2023-2024 school year featured LGBTQ+ characters, people, or themes.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">PEN America has tracked tactics used to ban books across the country. Religious freedom arguments are the latest way to try to get books, especially with LGBTQ themes and characters, banned. <\/span><i><span style=\"font-weight: 400;\">Mahmoud v. Taylor <\/span><\/i><span style=\"font-weight: 400;\">has the potential to dramatically escalate book bans across the country by giving legal cover to discriminatory censorship, particularly targeting LGBTQ narratives.<\/span><img decoding=\"async\" class=\"alignright wp-image-933504\" src=\"https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125017\/bobby.jpg\" alt=\"\" width=\"300\" height=\"381\" srcset=\"https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125017\/bobby.jpg 1512w, https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125017\/bobby-236x300.jpg 236w, https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125017\/bobby-806x1024.jpg 806w, https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125017\/bobby-768x975.jpg 768w, https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125017\/bobby-1210x1536.jpg 1210w, https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125017\/bobby-150x190.jpg 150w, https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125017\/bobby-450x571.jpg 450w, https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125017\/bobby-1200x1524.jpg 1200w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The American Library Association (ALA) <\/span><a href=\"https:\/\/www.ala.org\/bbooks\/book-ban-data\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">tracked<\/span><\/a><span style=\"font-weight: 400;\"> 414 book ban attempts against public school and library materials, encompassing 1,128 unique titles, in the first eight months of 2024.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The U.S. Supreme Court <\/span><a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24-297\/335502\/20241218150621210_24-297%20-%20Mahmoud%20v.%20Taylor%20-%20Brief%20in%20Opposition.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">agreed to hear<\/span><\/a><span style=\"font-weight: 400;\"> the plaintiffs\u2019 appeal after their requests to force the school district to provide opt outs while the case was being litigated lost in both the lower federal trial and appellate court. Federal Court of Appeals Judge Steven Agee <\/span><a href=\"https:\/\/casetext.com\/case\/mahmoud-v-mcknight-1\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">noted<\/span><\/a><span style=\"font-weight: 400;\"> there was no \u201cevidentiary link showing that the Storybooks are being implemented in a way that directly or indirectly coerces the Parents or their children to believe or act contrary to their religious faith.\u201d\u00a0\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Supreme Court reached out to take this case at a very early stage and potentially decide it on a group of parents\u2019 claims despite the fact that the case had not yet proceeded to the point where there was a record of how the books were actually being used in the classroom.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The authors and illustrators of books at issue in this lawsuit issued a <\/span><a href=\"https:\/\/pen.org\/mahmoud-v-taylor-supreme-court-case\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">statement<\/span><\/a><span style=\"font-weight: 400;\"> in support of inclusive books: &#8220;We stand in support of the Montgomery County School District. We oppose censoring or segregating books, like ours, that feature LGBTQ+ people. All families deserve to be seen and heard. To act otherwise is harmful and sends a devastating message to students: that their lives and families are so offensive and dangerous that they can\u2019t even be discussed in school.&#8221;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The books include the picture book <\/span><i><span style=\"font-weight: 400;\">Uncle Bobby\u2019s Wedding<\/span><\/i><span style=\"font-weight: 400;\">, a celebration of family featuring a girl who finds that her favorite uncle\u2019s marriage means she\u2019s gaining another uncle, not losing one. The book was selected as a best picture book honoree by <\/span><i><span style=\"font-weight: 400;\">Kirkus Reviews<\/span><\/i><span style=\"font-weight: 400;\">. Author Sarah Brannen told <\/span><a href=\"https:\/\/mombian.com\/2025\/01\/21\/supreme-court-to-hear-case-on-whether-reading-lgbtq-books-in-school-requires-parental-opt-out-option\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Mombian<\/span><\/a><span style=\"font-weight: 400;\">\u2019s Dana Rudolph: \u201cChildren need to see themselves in books. Allowing families to opt their children out of reading our books hurts the children whose lives and families are reflected in those books. \u201cOpt-out\u201d policies starkly communicate to classrooms of children that behaving decently to all human beings is optional and tells kids who are different that they and their families don\u2019t merit the respect of all their classmates.\u201d<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">There has been prior precedent in the federal circuit courts <\/span><a href=\"https:\/\/mombian.com\/2025\/01\/21\/supreme-court-to-hear-case-on-whether-reading-lgbtq-books-in-school-requires-parental-opt-out-option\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">ruling<\/span><\/a><span style=\"font-weight: 400;\"> in favor of access to inclusive books. For example, in 2008, The U.S. Supreme Court <\/span><a href=\"https:\/\/mombian.com\/2025\/01\/21\/supreme-court-to-hear-case-on-whether-reading-lgbtq-books-in-school-requires-parental-opt-out-option\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">declined to hear<\/span><\/a><span style=\"font-weight: 400;\"> an appeal by two Lexington, Mass., couples, leaving in place a First Circuit Court of Appeals decision that, like four other federal circuit courts of appeals, held that participation in public school instruction cannot alone burden the right to free exercise of religion absent some \u201ccoercive effect.\u201d The First Court held that merely exposing a child to ideas that conflict with the religious beliefs of their parents \u201cdoes not inhibit the parent from instructing the child differently.\u201d<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Opt-out <\/span><a href=\"https:\/\/mombian.com\/2025\/01\/21\/supreme-court-to-hear-case-on-whether-reading-lgbtq-books-in-school-requires-parental-opt-out-option\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">policies<\/span><\/a><span style=\"font-weight: 400;\"> are costly for taxpayers, student education, and schools: \u201cThe administrative burden of having to notify parents, collect their responses, answer any questions they may have about the material, and determine what the opted-out students will do during class time when the LGBTQ books are read may dissuade schools from including LGBTQ books in the first place.\u201d<\/span><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-933507\" src=\"https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125046\/puppy.jpg\" alt=\"\" width=\"300\" height=\"258\" srcset=\"https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125046\/puppy.jpg 1800w, https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125046\/puppy-300x258.jpg 300w, https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125046\/puppy-1024x881.jpg 1024w, https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125046\/puppy-768x660.jpg 768w, https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125046\/puppy-1536x1321.jpg 1536w, https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125046\/puppy-150x129.jpg 150w, https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125046\/puppy-450x387.jpg 450w, https:\/\/media.glaad.org\/wp-content\/uploads\/2025\/04\/10125046\/puppy-1200x1032.jpg 1200w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/www.americanprogress.org\/article\/book-banning-curriculum-restrictions-and-the-politicization-of-u-s-schools\/\" target=\"_blank\" rel=\"noopener\"><b>Center for American Progress:<\/b><\/a><span style=\"font-weight: 400;\"> Book bans \u201crequire tens of thousands of hours from teachers, librarians, and administrators to review the books and implement a system of censorship\u2014all at a time when school resources are already stretched thin, and states across the country are facing teacher and staff shortages.\u201d<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/firstbook.org\/blog\/2024\/12\/20\/how-book-bans-are-impacting-teachers-and-students-insights-from-first-book-research-insights\/\" target=\"_blank\" rel=\"noopener\"><b>First Book Research &amp; Insights:<\/b><\/a><span style=\"font-weight: 400;\"> A poll of 1,500 teachers and librarians revealed \u201cbook bans are negatively impacting their ability to teach,\u201d undermine their expertise, and \u201ccontribute to a sense of erasing people and history.\u201d Of the respondents, \u201c72 percent noted that when students\u2019 access to books is restricted, their reading engagement declines.\u201d<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/www.everylibraryinstitute.org\/review_recent_book_ban_polls-25\" target=\"_blank\" rel=\"noopener\"><b>EveryLibrary Institute:<\/b><\/a><span style=\"font-weight: 400;\"> Polling and surveys reveal \u201ca significant majority of the public opposes book bans, with a substantial majority of voters in some surveys supporting state legislation to protect individuals&#8217; rights to read freely. Some surveys show that as many as three-quarters of voters believe that ensuring people have access to diverse books is essential.
