{"id":928974,"date":"2025-02-18T10:47:09","date_gmt":"2025-02-18T15:47:09","guid":{"rendered":"https:\/\/glaad.org\/?p=928974"},"modified":"2025-02-19T09:34:19","modified_gmt":"2025-02-19T14:34:19","slug":"good-news-lgbtq-youth-activists-in-texas-curb-censorship-and-new-jersey-law-protects-transgender-students-from-discrimination","status":"publish","type":"post","link":"https:\/\/glaad.org\/good-news-lgbtq-youth-activists-in-texas-curb-censorship-and-new-jersey-law-protects-transgender-students-from-discrimination\/","title":{"rendered":"GOOD NEWS: LGBTQ Youth Activists in Texas Curb Censorship and New Jersey Law Protects Transgender Students from Discrimination"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">Major legal victories break through the anti-LGBTQ fury of the current administration and anti-LGBTQ politicians against youth and teen populations across the country.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In Texas, the student-led policy organization Students Engaged in Advancing Texas (SEAT) championed additional temporary injunctions on a Texas law barring freedom of speech for minors. Meanwhile, <\/span><a href=\"https:\/\/www.njcourts.gov\/system\/files\/court-opinions\/2025\/a0037-23a0046-23a0118-23.pdf?emci=7e7c21fc-e8e7-ef11-90cb-0022482a94f4&amp;emdi=4c10e5e4-efe7-ef11-90cb-0022482a94f4&amp;ceid=2947098\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">New Jersey Superior Court upheld an injunction<\/span><\/a><span style=\"font-weight: 400;\"> blocking three Monmouth County school districts from implementing policies that would\u2019ve forcibly outed transgender, Two-Spirit and gender nonconforming students.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As part of its education and advocacy \u201cGoing Local\u201d programming across the country, the <\/span><a href=\"https:\/\/glaad.org\/institute\/\"><span style=\"font-weight: 400;\">GLAAD Media Institute<\/span><\/a><span style=\"font-weight: 400;\"> (GMI) \u2013 GLAAD\u2019s training, research and consulting division \u2013 convened meetings with local leaders and community advocates in Texas and New Jersey in recent months and years. Attendees who completed a program or session with the GLAAD Media Institute were immediately deemed GLAAD Media Institute Alumni, who are equipped to maximize community impact by leveraging their own story for culture change.\u00a0<\/span><\/p>\n<h3><strong>Texas<\/strong><\/h3>\n<p><span style=\"font-weight: 400;\">On August 16, 2024, Foundation for Individual Rights and Expression (FIRE) <\/span><a href=\"https:\/\/www.thefire.org\/research-learn\/complaint-students-engaged-advancing-texas-v-paxton\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">sued<\/span><\/a><span style=\"font-weight: 400;\"> Texas Attorney General Ken Paxton on behalf of three plaintiffs from SEAT who use the internet to communicate with young Texans and keep them informed on issues that affect them, shared FIRE and SEAT\u2019s joint press release.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">With that said, Judge Robert Pittman, in a 37-page decision, ordered a <\/span><a href=\"https:\/\/www.thefire.org\/research-learn\/order-granting-part-and-denying-part-plaintiffs-motion-preliminary-injunction\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">stop to the enforcement<\/span><\/a><span style=\"font-weight: 400;\"> of three provisions<\/span><span style=\"font-weight: 400;\"> of <\/span><span style=\"font-weight: 400;\">Texas law \u201cSecuring Children Online Through Parental Empowerment Act\u201d (also known as the SCOPE Act or HB 18). Blocked provisions include <\/span><span style=\"font-weight: 400;\">required content monitoring and filtering, targeted advertising bans, and age-verification requirements.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<h3><em><strong>RELATED: <a href=\"\/glaad-institute-alum-of-students-engaged-in-advancing-texas-is-fighting-lgbtq-censorship-in-the-lone-star-state-and-us\/\">GLAAD Institute Alum and Texas Activist is Fighting LGBTQ Censorship in the Lone Star State and the U.S.<\/a><\/strong><\/em><\/h3>\n<p><span style=\"font-weight: 400;\">\u201cIf we think we\u2019re actually right, we have to take it up to the courts because our direct advocacy and organizing can only go so far,\u201d GLAAD Media Institute Alum, <a href=\"\/20-under-20\/2024\/\">Teen Vogue&#8217;s 2024 20 Under 20<\/a>, and Deputy Executive Director of SEAT <b>Da\u2019Taeveyon Daniels<\/b><\/span><b>\u00a0<\/b><span style=\"font-weight: 400;\">said in opposition of the SCOPE ACT. \u201cGetting the ruling back that we have right now, it sends a really strong message that young people\u2019s rights matter.\u201d<\/span><\/p>\n<blockquote class=\"instagram-media\" style=\"background: #FFF; However, the decision by Pittman concluded that the \u201cparental rights\u201d coveted legislation is\u00a0 \u201c<\/span><span style=\"font-weight: 400;\">unconstitutionally over broad, vague, and not narrowly tailored to serve a compelling state interest.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Additionally, the SCOPE ACT aims to prohibit content found to \u201cpromote, glorify, or facilitate \u2026 grooming, child pornography, suicide\u201d among other trigger labels manufactured as a disguise for disinformation to be construed as fact, according to <\/span><a href=\"\/smsi\/anti-lgbtq-online-hate-speech-disinformation-guide\/#groomer\"><span style=\"font-weight: 400;\">GLAAD research and guidance<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">With all evidence in mind, \u201c&#8230;the Court finds that HB 18 produces a \u2018determinative or coercive effect\u2019 on [social media companies], which results in preventing speech and produces Plaintiffs\u2019 injuries, as is required to show standing,\u201d Pittman ruled.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWhen we (SEAT) think of social media , we have to view it as what it is, it\u2019s more than entertainment, it\u2019s a tool that we use for connection, advocacy, and survival, specifically LGBTQ+ youth,\u201d Daniels said.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Laws like the SCOPE ACT do not protect LGBTQ youth or youth in general, the youth activist shared.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWe should be focusing on how we can teach youth people how to be safe online as opposed to basically secluding them for the duration of their lives just for them to be hit by whiplash at the ripe age of 18,\u201d Daniels continued.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Daniels speaks to a larger calling for youth in public life and that is to educate instead of erase the lives and reality of young people.\u00a0<\/span><\/p>\n<h3><strong>New Jersey<\/strong><\/h3>\n<p><span style=\"font-weight: 400;\">In June of 2023 three school districts \u2013 Marlboro, Manalapan-Englishtown, and Middletown \u2013 amended their guidance for transgender students to have a forced outing measure. \u201cForced outing,\u201d or \u201cparental notification,\u201d is when a school makes a decision to notify a parent of a student\u2019s social transition at school. This is specific to the at-large transgender community, also an umbrella term for nonbinary and gender nonconforming identities.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">These 2023 decisions of the board went directly against New Jersey\u2019s best guidance in the original policy titled <\/span><a href=\"https:\/\/www.straussesmay.com\/seportal\/Public\/DistrictPolicy.aspx?policyid=5756&amp;id=bb92c745e4a040debb77a504d1b733ac\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">5756<\/span><\/a><span style=\"font-weight: 400;\">. \u201cThe school district shall accept a student\u2019s asserted gender identity; parental consent is not required,\u201d reads the original guidance.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Following the institution of the forced outing measure, the <\/span><span style=\"font-weight: 400;\">o<\/span><span style=\"font-weight: 400;\">ffice of the Attorney General swiftly followed the measure up with a civil rights complaint against all three school boards and filed motions in Superior Court to stop the policies from going into effect while the challenges were pending<\/span><span style=\"font-weight: 400;\">. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">That\u2019s exactly what happened. It&#8217;s not every day you get to read a 34-page legal decision in which a powerful court outlines why and how New Jersey law unequivocally protects transgender and gender diverse students!\u201d Miller said.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Former New Jersey Gov. Chris Christie passed NJ S3067 (16R) in 2017, requiring the state\u2019s education commissioner to \u201c<\/span><a href=\"https:\/\/legiscan.com\/NJ\/text\/S3067\/id\/1644864\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">develop guidelines for school districts (K-12) on addressing common issues concerning the needs of transgender students<\/span><\/a><span style=\"font-weight: 400;\">.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Thus, Policy 5756 , or\u00a0 \u201c<\/span><a href=\"https:\/\/www.nj.gov\/education\/safety\/sandp\/climate\/docs\/Guidance.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Transgender Student Guidance for School Districts<\/span><\/a><span style=\"font-weight: 400;\">,\u201d was born.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nevertheless, it wasn\u2019t long before Moms for Liberty attempted undoing decades of advocacy and legal victories for the LGBTQ community. Moms for Liberty has chapters within and along all the borders of the Garden State, including those it shares with major cities like New York City and Philadelphia, according <\/span><a href=\"https:\/\/www.momsforliberty.org\/chapters\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">to their website<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201c<\/span><span style=\"font-weight: 400;\">Our trans youth deserve to be safe and affirmed in schools,\u201d said GLAAD Media Institute Alum and Garden State Equality Project Manager and Trainer <\/span><b>Hime Sarah Thomas<\/b><span style=\"font-weight: 400;\">. \u201cThe injunction allows for a level of security for trans youth to disclose their identities in their own time and comfortability without the fear of being outed against their will.\u201d<\/span><\/p>\n<h3><em><strong>RELATED: <a href=\"\/new-jersey-lgbtq-advocates-from-garden-state-equality-say-theyll-continue-to-pushback-with-facts\/\">New Jersey LGBTQ Advocates from Garden State Equality Say They\u2019ll Continue to Pushback with Facts<\/a><\/strong><\/em><\/h3>\n<p><span style=\"font-weight: 400;\">The decision states that New Jersey\u2019s anti-discrimination law makes it unlawful for schools to subject individuals to discrimination based on their &#8220;gender identity or expression,&#8221; showing how New Jersey\u2019s Law Against Discrimination harm reduces instead of instigating it, reports journalists.\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/www.erininthemorning.com\/p\/in-major-win-for-trans-students-new\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Erin in The Morning<\/span><\/a> <span style=\"font-weight: 400;\">reported that: \u201cThis ruling reinforces that the state has both the legal right and a compelling interest in protecting transgender students from policies that would expose them to harm and discrimination.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">With that said, since \u201c<a href=\"https:\/\/www.nj.gov\/education\/safety\/sandp\/climate\/docs\/Guidance.pdf\" target=\"_blank\" rel=\"noopener\">Transgender Student Guidance for School Districts<\/a>,\u201d is simply suggested guidance, it is likely these three school districts will abolish the policy. Brian Cohen, the president of the Marlboro Township Board of Education, told Patch news that the board members have been advised of three options going forward:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u201cDo nothing with the current policy (which would be Policy 5756, not the amended one<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u201cAmend Policy 5756 again, though the amendment could be subject to state action<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u201cAbolish or rescind Policy 5756\u201d<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">With a number of elections coming up in 2025, New Jersey remains a battleground state for LGBTQ equality in the coming years.
