What is even more urgently needed is accountability via external oversight and regulation of the entire industry, to protect the public interest from the harmful business practices and product designs of social media companies. As GLAAD has previously <a href=\"\/releases\/glaad-resource-for-coverage-of-january-31-us-senate-judiciary-committee-hearing\/\">noted<\/a>, amidst the complexities of the many current U.S. legislative proposals intending to try to fix these problems, and especially the many proposals focused on youth safety, it is important that such approaches be carefully crafted lest they create potential harms and unintended negative impacts for LGBTQ people and other marginalized communities (and everyone). To preserve LGBTQ rights and safety, regulatory solutions should focus on addressing specific harmful business practices of tech companies, such as <a href=\"https:\/\/www.amnesty.org\/en\/tech\/surveillance-giants\/\" target=\"_blank\" rel=\"noopener\">surveillance advertising<\/a> and over-aggressive <a href=\"https:\/\/www.pewresearch.org\/internet\/2019\/11\/15\/americans-and-privacy-concerned-confused-and-feeling-lack-of-control-over-their-personal-information\/\" target=\"_blank\" rel=\"noopener\">collection and misuse of user data<\/a>, versus proposals that would actually <em>expand<\/em> collection of data and potentially expose people to government surveillance or lead to suppression and censorship of LGBTQ material. The chilling impact of 2018\u2019s misguided FOSTA-SESTA (Fight Online Sex Trafficking Act and Stop Enabling Sex Traffickers Act) <a href=\"https:\/\/journals.sagepub.com\/doi\/10.1177\/01968599231220925\" target=\"_blank\" rel=\"noopener\">legislation<\/a> should be an object lesson that attempts to solve problems can create grave new impacts, especially for historically marginalized communities. In the case of FOSTA-SESTA, the broad consensus from researchers, legal scholars, and even the Government Accountability Office is that, as historian Sascha Cohen <a href=\"https:\/\/www.thenation.com\/article\/society\/fosta-sesta-avs-bills-sex-work\/\" target=\"_blank\" rel=\"noopener\">writes<\/a> in her in-depth overview in <em>The Nation<\/em>: \u201cthe law has been counterproductive at best and deadly at worst.\u201d FOSTA-SESTA has especially impacted LGBTQ people and sex workers, resulting in a situation where, as Melissa Gira Grant <a href=\"https:\/\/newrepublic.com\/article\/162823\/sex-trafficking-sex-work-sesta-fosta\" target=\"_blank\" rel=\"noopener\">pointed out<\/a> in <em>The New Republic<\/em>, \u201cThe \u2018solution\u2019 became the problem.\u201d (To learn more, read the aforementioned <a href=\"https:\/\/www.thenation.com\/article\/society\/fosta-sesta-avs-bills-sex-work\/\" target=\"_blank\" rel=\"noopener\">feature<\/a> in <em>The Nation<\/em>). There are other approaches to addressing children\u2019s safety online which should rightly put the burden on platforms to address these issues for <em>all<\/em> users.<\/p>\n<p>Delving into why kids-only legislation won\u2019t solve the problem of widespread online manipulation and harm, Nora Benevidez (lead author of the 2023 Free Press report, <a href=\"https:\/\/www.freepress.net\/big-tech-backslide-report\" target=\"_blank\" rel=\"noopener\"><em>Big Tech Backslide<\/em><\/a>) observes in a January 2024 <em>Tech Policy Press<\/em> <a href=\"https:\/\/www.techpolicy.press\/us-leaders-must-advance-big-ideas-to-protect-our-digital-civil-rights\/\" target=\"_blank\" rel=\"noopener\">article<\/a>: \u201cComprehensive privacy and civil rights protections are possible. They would also avoid the pitfalls of well-intentioned legislation that claims to reduce harm and remove harmful content but actually exposes everyone, including children and teens, to more invasive practices and government overreach. The most powerful step we can take now to rein in online manipulation is to introduce and pass robust federal data-privacy legislation that would limit the data collected about, and then used against, all of us.\u201d<\/p>\n<p>Of course social media companies engage in business practices that prioritize their corporate profits and bottom line rather than prioritizing the best interests of society. This is a fundamental reality of all industries, and not a surprising one. The EPA, FDA, SEC, and other regulatory agencies came into existence for this very reason. Indeed, creating guidelines and oversight to ensure the public health and safety of the American people is not a radical idea. Although tech and social media companies may be under-regulated in the US, thankfully there are existing public agencies which do have some jurisdiction over the industry. For instance, the <a href=\"https:\/\/www.ftc.gov\/terms\/social-media\" target=\"_blank\" rel=\"noopener\">Federal Trade Commission (FTC)<\/a> continues to protect the public interest through various mechanisms like its <a href=\"https:\/\/www.theverge.com\/2024\/4\/5\/24121968\/meta-motion-for-summary-judgment-ftc-monopoly-lawsuit\" target=\"_blank\" rel=\"noopener\">ongoing antitrust case against Meta<\/a> or via imposing fines, as it has in <a href=\"https:\/\/www.scmagazine.com\/news\/ftc-facebook-broke-terms-5b-data-privacy-settlement\" target=\"_blank\" rel=\"noopener\">Meta\u2019s cases of repeated data privacy violations<\/a> such as the Facebook Cambridge Analytica case. In May 2023 Samuel Levine, director of the FTC\u2019s Bureau of Consumer Protection <a href=\"https:\/\/www.usatoday.com\/story\/tech\/news\/2023\/05\/03\/meta-facebook-ftc-proposal-kids-data\/70180349007\/\" target=\"_blank\" rel=\"noopener\">stated that<\/a>: \u201cFacebook has repeatedly violated its privacy promises. The company\u2019s recklessness has put young users at risk, and Facebook needs to answer for its failures.\u201d<\/p>\n<p>Delving into the array of regulatory situations across the globe \u2014 including the work of <a href=\"https:\/\/techpolicy.press\/the-digital-services-act-how-is-europe-planning-to-regulate-tech\/\" target=\"_blank\" rel=\"noopener\">the EU\u2019s Digital Services Act (DSA)<\/a>, the <a href=\"https:\/\/www.esafety.gov.au\/industry\" target=\"_blank\" rel=\"noopener\">Australian eSafety Commissioner<\/a> and <a href=\"https:\/\/www.cnbc.com\/2023\/05\/24\/irish-data-regulator-defends-1point3-billion-meta-fine.html\" target=\"_blank\" rel=\"noopener\">others<\/a> \u2014 is beyond the scope of this report. But it is illuminating to see that other governments around the world are taking rigorous approaches to protect the public interest over the business interests of corporations, via <a href=\"https:\/\/www.brookings.edu\/articles\/road-testing-big-tech-regulation-in-europe\/\" target=\"_blank\" rel=\"noopener\">regulation of tech and digital business models and practices<\/a>.<\/p>\n<p>While implementation of oversight may be a long and complex process, lawmakers must find solutions that do not create new problems, solutions that require companies to be accountable and transparent, solutions that protect us all.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>An excerpt from the GLAAD 2024 Social Media Safety Index, forthcoming in May 2024.
