A conservative parents&#8217; group challenged the policy though none of the parents involved have a student affected by the policy. Alito emphasized, without basis, that the policy is a violation of parents&#8217; constitutional rights to make decisions about their children&#8217;s upbringing. He baselessly characterized the school district&#8217;s actions as encouraging students to transition to a new gender without parental knowledge or consent, framing this as a significant national issue. In fact, the school district explained, \u201cAll Gender Support Plans are maintained in a student\u2019s permanent pupil records file. \u2026 Even if a student does not want their parents to know about their gender identity issues or the existence of the Gender Support Plan, they are specifically advised that the Gender Support Plan is a pupil record that is always available to their parents and that it is \u2018not a privileged document between the student and the school district.\u2019\u201d Alito indicated his support for allowing more lawsuits that could challenge LGBTQ rights.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u2014<\/span><span style=\"font-weight: 400;\">With his wife, Martha-Ann Alito, <\/span><a href=\"https:\/\/www.nytimes.com\/2024\/06\/10\/us\/politics\/alito-pride-flag.html\"><span style=\"font-weight: 400;\">flew a so-called \u201cAppeal to Heaven\u201d flag<\/span><\/a><span style=\"font-weight: 400;\"> at their New Jersey beach home in the summer of 2023; that flag, which has its origins in the Revolutionary War, is now a symbol of supporters of Donald J. Trump\u2019s \u201cStop the Steal\u201d campaign, and for an effort to remake the government in the Christian nationalist mode. Mrs. Alito was recorded as saying that she would like to fly a <\/span><a href=\"https:\/\/www.nytimes.com\/2024\/06\/10\/us\/politics\/alito-pride-flag.html\"><span style=\"font-weight: 400;\">\u201cshame\u201d flag<\/span><\/a><span style=\"font-weight: 400;\"> in response to having to see a Pride flag in her neighborhood.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u2014<a href=\"https:\/\/www.lawdork.com\/p\/alito-bud-light-stock-sale-anti-trans-boycott\">Sold<\/a> at least some of his stock in Anheuser-Busch and bought stock in Molson Coors on Monday, August 14, 2023, a day after anti-LGBTQ social media extremists targeted and misgendered transgender influencer Dylan Mulvaney during a <\/span>manufactured <a href=\"https:\/\/www.vox.com\/money\/2023\/4\/12\/23680135\/bud-light-boycott-dylan-mulvaney-travis-tritt-trans\" rel=\"\">controversy<\/a> over her receiving a can of beer in a Bud Light campaign. The attacks on Mulvaney led to a boycott of the beer and its parent company, Anheuser-Busch.<\/p>\n<p>\u2014<a href=\"https:\/\/www.nytimes.com\/2024\/05\/16\/us\/justice-alito-upside-down-flag.html\" target=\"_blank\" rel=\"noopener\">Displayed a &#8220;stop the steal&#8221; symbolic upside-down U.S. flag<\/a> at his home days after the deadly insurrection at the Capitol and as the Court was considering and election case. Many Trump supporters who rejected the outcome of the election displayed the inverted flag outside their homes or in social media. The justices also would rule on two cases involving the storming of the Capitol on Jan. 6, including whether Mr. Trump has immunity for his actions. The Court code of conduct states, \u201cA Justice should not engage in other political activity.\u201d Justice Alito, who agreed, as did all the justices, to a <a href=\"https:\/\/www.lawdork.com\/p\/supreme-court-code-of-conduct\" target=\"_blank\" rel=\"noopener\">code of conduct<\/a>, did not recuse himself. Justice Alito blamed the inverted flag on his wife, Martha Ann, saying she hung it to send message to neighbors.<\/p>\n<p><span style=\"font-weight: 400;\">\u2014<a href=\"https:\/\/apnews.com\/article\/abortion-us-supreme-court-health-samuel-alito-66c301d223759e842ad95e89f597d587\" target=\"_blank\" rel=\"noopener\">Wrote<\/a> the Supreme Court decision overturning <em>Roe v. Wade<\/em> and stripping the near 50-year constitutional right to abortion, claiming the justices who decided <em>Roe<\/em> \u201cusurped the power to address a question of profound moral and social importance that the Constitution unequivocally leaves for the people,&#8221; neglecting to note that a decision to have an abortion is made a person, the patient. Alito claimed that the decision should not be interpreted to threaten other rights\u00a0 of privacy such as marriage equality and contraception: &#8220;our decision is not misunderstood or mischaracterized, we emphasize that our decision concerns the constitutional right to abortion and no other right. Nothing in this opinion should be understood to cast doubt on precedents that do not concern abortion.\u201d Justice Thomas, one of the &#8220;we&#8221; voting with Alito to overturn Roe, contradicted Alito in a <a href=\"https:\/\/www.politico.com\/news\/2022\/06\/24\/thomas-constitutional-rights-00042256\" target=\"_blank\" rel=\"noopener\">concurrence<\/a> directly challenging decisions that expanded privacy rights for all Americans and LGBTQ Americans, including <em>Obergefell<\/em> (marriage), <em>Lawrence<\/em> (same-sex relationships), and <em>Griswold<\/em> (contraception), claiming those decisions should be &#8220;reconsidered.&#8221;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u2014\u00a0<\/span><a href=\"https:\/\/newrepublic.com\/post\/179149\/supreme-court-samuel-alito-traditional-people-bigots-lgbtq\"><span style=\"font-weight: 400;\">Renewed<\/span><\/a><span style=\"font-weight: 400;\"> his criticism of the <em>Obergefell<\/em> decision that the fundamental right to marry is guaranteed to same-sex couples by the Constitution. Regarding a case involving whether it is permissible to remove anti-LGBTQ people from juries involving discrimination against LGBTQ people, Alito wrote a <\/span><a href=\"http:\/\/archive.today\/2XFFE\"><span style=\"font-weight: 400;\">statement<\/span><\/a><span style=\"font-weight: 400;\"> claiming that the case \u201cexemplifies the danger that I anticipated in <em>Obergefell v. Hodges<\/em>\u201d and warning that the decision means \u201cAmericans who do not hide their adherence to traditional religious beliefs about homosexual conduct\u201d are being \u201clabeled as bigots and treated as such\u201d by the government and \u201csociety.\u201d<\/span><\/p>\n<p>\u2014<a href=\"https:\/\/slate.com\/news-and-politics\/2020\/11\/alito-federalist-society-speech-insane.html\">Delivered<\/a>\u00a0what&#8217;s described as an ultrapartisan speech to\u00a0The Federalist Society, targeting the response to the COVID-19 pandemic and public safety restrictions against churches, as well as marriage equality, LGBTQ nondiscrimination laws and access to contraception. Falsely <a href=\"https:\/\/twitter.com\/mjs_DC\/status\/1327060975045009409\">claimed <\/a>the Supreme Court\u2019s <em>Obergefell v. Hodges<\/em> ruling restricts free speech rights of anti-LGBTQ advocates.<\/p>\n<p>\u2014Alongside Associate Justice Clarence Thomas, Alito <a href=\"https:\/\/www.npr.org\/2020\/10\/05\/920416357\/justices-thomas-alito-blast-supreme-court-decision-on-gay-marriage-rights\">attacked the court\u2019s 2015 <em>Obergefell <\/em>decision<\/a> when they declined to hear a case brought by Kentucky county clerk Kim Davis. The two justices wrote that Davis \u201cmay have been one of the first victims of this court&#8217;s cavalier treatment of religion in its <em>Obergefell<\/em> decision,&#8221; and described the \u201cconsequences for religious liberty\u201d as \u201cruinous.\u201d They also wrote that the <em>Obergefell<\/em> decision \u201cenables courts and governments to brand religious adherents who believe that marriage is between one man and one woman as bigots, making their religious liberty concerns that much easier to dismiss.\u201d<\/p>\n<p>\u2014<a href=\"https:\/\/www.supremecourt.gov\/opinions\/14pdf\/14-556_3204.pdf\">Dissented in the <em>Obergefell<\/em> case<\/a>, writing that bans on same-sex marriage promote procreation and the ideal environment for raising children. He also wrote that those who oppose marriage equality \u201cwill risk being labeled as bigots and treated as such by governments, employers, and schools,&#8221; leading to &#8220;bitter and lasting wounds.&#8221;<\/p>\n<p>\u2014Along with Associate\u00a0Justice Brett Kavanaugh, <a href=\"https:\/\/www.advocate.com\/politics\/2019\/11\/07\/after-photo-emerges-alito-kavanaugh-urged-recuse-lgbtq-cases\">Alito posed for a photo<\/a> with anti-LGBTQ activists <a href=\"\/gap\/brian-brown\">Brian Brown<\/a>, Catholic Cardinal Gerhard M\u00fcller and Princess Gloria von Thurn und Taxis.<\/p>\n","protected":false},"author":435,"featured_media":853878,"template":"","categories":[138754],"tags":[],"region":[138565],"hashtag":[138638,138632,138637],"class_list":{"0":"post-506102","1":"gap","2":"type-gap","3":"status-publish","4":"has-post-thumbnail","6":"category-gaps","7":"region-national","8":"hashtag-law","9":"hashtag-politics","10":"hashtag-religion"},"aioseo_notices":[],"apple_news_notices":[],"aioseo_head":"\n\t\t<!-- All in One SEO Pro 4.8.1.1 - aioseo.com -->\n\t<meta name=\"description\" content=\"\u2014In a request for review, Alito, along with Justice Clarence Thomas, expressed a desire for the Supreme Court to take up a case challenging a Wisconsin school district&#039;s policy that supports students&#039; gender expression.
